The price of each Offering, displayed on the Internet Site, is understood to include all taxes, to which may or may not be added delivery charges (if the Gift Box option has been selected), which will be indicated to the Customer before the final validation of his order.
ARLETTIE LES ÉCHAPPÉES draws the Customer's attention to the fact that it may happen that an error affects the price of the Service. In this case, it reserves the right to cancel any Order in the event of a display or technical error which renders the price of the Order manifestly low or derisory.
The price indicated is the price offered by the Partner for the Échappée chosen over a given period which it proposes to put on sale at a preferential rate through ARLETTIE LES ÉCHAPPÉES.
The price of the service purchased is payable in cash, in full, on the day the order is placed by the Customer.
It does not include the additional charges that each Partner may apply in its establishment, linked in particular to the tourist tax, the presence of animals, or any additional service subscribed to by the Beneficiary after the order has been placed.
In the absence of any mention to the contrary in the description of the Services, the price of the Order does not include the following items: transfers; insurance; paid activities; on-site communications (telephone, wifi, etc.); extras not included in the Service (parking, 24/24 reception, room service, bar, catering, laundry, meals, drinks, excursions, visits, etc.); administrative formalities; tips, etc...
Please note that it is standard practice in the hotel industry to take a credit card pre-authorization at check-in to cover personal consumption not included in the price paid, as well as tourist taxes.
When the online order is validated, ARLETTIE LES ÉCHAPPÉES collects the price of the service in the name and on behalf of the selected Partner.
ARLETTIE LES ÉCHAPPÉES will issue an invoice to the customer, which it will send by email.
Payment is made online, at the purchaser's choice, at the time of validation of the order by the Customer:
- By credit card (Carte Bleue, Visa, Eurocard/Mastercard, American Express) by entering the card number, validity date and control code on the back of the card in the appropriate field;
- The customer may also choose to pay by PayPal. After choosing this payment method, the Customer will be redirected to the PayPal website. The customer must enter his or her login and password and proceed with payment.
Authorization to debit the card is requested when the order is validated on the Site, except in the event of server unavailability.
Arlettie reserves the right to make a new direct debit authorization request if the first request is unsuccessful due to server unavailability.
In the event of non-payment, incorrect address or any other problem with the Customer's account, Arlettie reserves the right to block the Customer's order until the problem has been resolved.
Arlettie uses all necessary means to ensure the confidentiality and security of banking data transmitted on the Site.
The Site is equipped with an online payment security system that encrypts customer data. Payment information is transmitted according to the highest security standards. The transmission of banking data is guaranteed by Arlettie's partner: Shopify Payment. At the Customer's request, it will also be possible to send the Beneficiary an e-mail notification of the purchase of the selected Échappée with the relevant details.
The Customer may also choose to have a box containing a reminder of the service ordered and the single-use code required to book the Échappée with the Partner sent to his/her postal address, or to have it delivered to the Beneficiary's postal address at the rate proposed by ARLETTIE LES ECHAPPEES at the time of his/her request
Delivery will take place within a reasonable time, and at the latest within 30 days of order confirmation, validation of the delivery choice and provision of the Beneficiary's contact details.
In the event of difficulty, the ARLETTIE LES ÉCHAPPÉES after-sales service should be contacted without delay via the contact form or by telephone on 01.88.40.36.32.
The same shall apply if the Customer makes an error that prevents or delays receipt of the gift box, without ARLETTIE LES ÉCHAPPÉES or the Partner being held liable in this respect.
By default, invoices are sent to the e-mail address indicated by the Customer at the time of confirmation
In the absence of compliance with the procedures set out in these General Terms and Conditions, no claim by the Customer will be accepted.
To follow up on the requested delivery, the customer will receive an order confirmation email accompanied by a delivery note. Once the order has been handed over to the carrier (dispatched status), a link enabling the Customer to track the parcel will be sent to the Customer by e-mail.
If the delivery time is exceeded, the Customer will not be entitled to cancel the sale or request a refund of any sums paid, except for delivery charges, which may be refunded on request. The service will remain bookable using the unique code sent by e-mail when the order is confirmed.
Article 6 – Availability and validity of the offer
The dates of availability of the Offer can be consulted online when the order is placed under the special conditions, which will be assimilated to these general conditions as being linked to them.
ARLETTIE LES ÉCHAPPÉES will put the Customer and/or the Beneficiary of the Échappée in contact within the limits of the availability and capacity of the Partner establishment.
In the event of the Échappée being unavailable during the open 12-month period due to the Provider, the Beneficiary will be informed and will have the right to cancel the order and obtain reimbursement within a reasonable period of time.
Under no circumstances will the Beneficiary be able to claim reimbursement for the Échappée due to his or her own unavailability during this 12-month period. The aforementioned clause is for the sole benefit of the Service Provider.
ARLETTIE LES ÉCHAPPÉES shall not be held liable for the unavailability of the Échappée nor shall it entitle the Customer or the Beneficiary to damages.
The purchase of an Échappée opens a validity period of 12 months starting from the date of purchase and not the date of reservation with the Partner.
The purchase of an Échappée by the Customer - who will not necessarily be the Beneficiary - will require a compulsory reservation with the Partner, subsequent to the purchase, in order to make use of the service offered.
The Beneficiary, armed with the unique code given to him/her when the order is confirmed, must contact the Partner directly to reserve the service and choose the dates of his/her stay.
Reservations must be made during the period of validity of the offer.
The date on which the stay is to take place may be outside the period of validity, but must begin no later than the last day of validity of the offer.
If the validity period of the Offer is exceeded, the Offer will not be refundable and will be considered definitively acquired by the Partner.
No modification of a reservation validated by the Beneficiary will be accepted without the direct agreement of the Partner.
Article 7 - Right of withdrawal
The Customer has a right of withdrawal of fourteen (14) calendar days from the date of receipt of his/her order by e-mail (after confirmation of payment).
The aforementioned 14-day period runs from the day of receipt of the e-mail / single-use code validated by the Customer, and ends with the expiry of the last hour of the last day of the 14-day period.
Only the person who has purchased the Service may exercise his right of withdrawal by contacting customer service via the contact form, before the expiry of the period stipulated in article L.221-18.
The Customer must provide the following information:
- Name and surname ;
- Order number ;
- The name of the Escapade that is the subject of the withdrawal;
- The single-use code that will have been communicated to him/her when the order was confirmed.
Arlettie will acknowledge receipt of the Customer's withdrawal.
Once the Customer has exercised his/her right of withdrawal, the purchased Échappée will be deactivated and can no longer be used. There will be no need to return it.
Any retraction carried out in accordance with the conditions of the present article will give rise to a reimbursement of all sums paid, excluding “express” delivery costs, within fourteen (14) days of the date on which the Customer informed Arlettie of his/her decision to retract.
Refunds will be made using the same method of payment used for the initial transaction.
Article 8 – Assignment of contract - Cancellation or modification of reservation
The Customer or the Beneficiary will have the possibility of transferring their Échappée to a third party, provided that they meet all the conditions of the contract (majority, etc.) and that they inform ARLETTIE LES ECHAPPÉES and the Partner in charge of the service by any means that allows an acknowledgement of receipt to be obtained. Acknowledgement of receipt of this information must be obtained no later than 7 days before the start of les Échappées.
Except in the case of retraction under the conditions set out above, no reimbursement will be considered, including in the event of the beneficiary's unavailability for any reason whatsoever.
No modification of a reservation validated by the Beneficiary will be accepted without the direct agreement of ARLETTIE and the Partner. Modification means a change of date in the same Partner establishment and for the same service. Any other case will be considered as a cancellation.
No reimbursement will be made for any service cut short or not taken up by the Customer or the Beneficiary, for any reason whatsoever, particularly in the event of no-show or late arrival at the Partner's establishment.
As les Échappées is offered for sale at a very preferential rate, it will be considered as “non-cancellable and non-refundable”.
It is understood that any cancellation by the Customer or the Beneficiary of the Échappée ordered will result in the application of fees equivalent to 100% of the amount of the service.
In the event that the Customer has taken out optional insurance, he/she must contact the insurance company in question, which will be solely responsible for handling the cancellation request to the exclusion of ARLETTIE or the Partner Provider. In any event, the Customer is informed that the cost of taking out optional insurance is never reimbursed in the event of cancellation or modification of the reservation.
Article 9 – Insurance
It is the responsibility of the Customer or Beneficiary to take out insurance, if they so wish.
Unless otherwise indicated on the Site for a particular service, no insurance is included in the services offered.
Article 10 – Warranty - Liability
The Partners selected by ARLETTIE LES ÉCHAPPÉES have declared to ARLETTIE LES ÉCHAPPÉES that they hold professional liability insurance for amounts that are known to be sufficient for the provision of the proposed service, and that they hold all the diplomas and authorizations enabling them to carry out their activities in a regular manner and in compliance with the applicable legal and regulatory provisions.
The Beneficiary is reminded that the provision of services in good safety conditions does not exempt him/her from observing the elementary rules of caution for sporting activities, in particular those known as “risky”, for which he/she is invited to check that he/she has sufficient insurance cover.
The Beneficiary is informed that when the service includes a meal, the menu is one agreed in advance between the Partner (restaurateur, hotelier) and ARLETTIE LES ÉCHAPPÉES, which may change according to seasonal products and their availability.
In the event of any dietary constraints whatsoever, the Beneficiary will be invited to contact the Partner beforehand to check the possibility of adapting the proposed menu.
Please note that the photographs and editorial content presented in the Échappées are not contractual and are subject to change.
In accordance with the legal provisions applicable to tourist stays, ARLETTIE LES ÉCHAPPÉES will be liable by operation of law in its capacity as retailer, in the event of a contractual breach in the performance of the services, so that the Beneficiary will have the possibility of addressing ARLETTIE LES ÉCHAPPÉES and/or the defaulting Partner equally in the event of any difficulty linked to the performance of the service.
It is specified that ARLETTIE LES ÉCHAPPÉES cannot be held responsible for any loss or theft committed during the stay, and that the Beneficiary will be invited to contact the Partner directly in the event of any complaint or dissatisfaction in this respect.
ARLETTIE LES ÉCHAPPÉES shall also not be held liable for any non-performance or improper performance of all or part of the Service which may be attributable, in whole or in part, to the Beneficiary or to a case of force majeure, in accordance with the provisions of article L211-16 of the French Tourism Code.
